Colorado Home Owners Associations (HOAs)

In Colorado, an HOA is a special kind of non-profit organization defined in Colorado law with certain constraints and requirements. As required by law, our HOA non-profit entity is registered with the state. Much information about HOAs and Colorado law can be found at the Colorado HOA Information and Resources Center. In addition to Colorado law, HOAs are also defined by their Bylaws, Covenants, and property boundary defining maps. Colorado law also requires HOAs to define many of their policies in writing. While these don't really define an HOA, this seemed a like as good place to mention them.

Oakridge Village III Bylaws

Our bylaws define how our HOA operates as an organization. The defined things like membership, voting, meetings, the board of directors, etc. The bylaws must be consistent with Colorado state law. To this end, because of some changes in Colorado law, our bylaws were modified in 2013.

Oakridge Village III Covenants

Our covenants (aka Declaration of Covenants, Conditions and Restrictions or DCCRs) essentially define in general terms the responsibilities of and restrictions on homeowners in our HOA. Our Board of Directors is responsible for defining the more specific details. As the same time as our bylaws were modified in 2013 due to changes in state law, our covenants were also modified. Our covenants documentation currently exists as two separate documents: the original covenants and the 2013 amendments to these covenants.

Below is a screenshot of the boundaries of the Oakridge Village 3rd (Oakridge Village III), 4th (Spanish Oak Ct.), and 5th (Twin Oak Ct.) filings from the Larimer County Maps website. The common property owned and maintained by the HOA consists of the greenbelt along Lemay Avenue, the fence between this greenbelt and the back of homeowners yards, and narrow strips of land around the walk-through sidewalks between the four cul-de-sacs and the sidewalk along Lemay. The city of Fort Collins maintains the sidewalk along Lemay and the trees between this sidewalk and the street. The north and south ends of the greenbelt along Lemay are owned by the 4th (Spanish Oak Ct.) and 5th (Twin Oak Ct.) filings, but these areas are watered by the Oakridge Village III HOA sprinkler system. As a result, Oakridge Village III maintains these two strips of greenbelt (with the current exception of the landscaping on the north east corner of Lemay and Keenland) and the 4th and 5th filings pay a proportionate fraction of the greenbelt maintenance costs.

This document contains the following note showing that the homeowners association owns small strips of land at the end of each court that include the walk-through sidewalks: "Admin. Change: Note - Access easements deeded to home owners assoc. including installed walks & landscaping."
